By booking or participating in a retreat and any related products or services (a “Retreat”) with Rogue Wave Collective LLC doing business as Women of the Wild (“WOW,” “we,” “us,” or the “Retreat Operator”), you (“you” or “Participant”) agree to these Terms & Conditions (the “Terms”).
Booking Process: To book a Retreat, you must complete the registration process and submit payment as specified. A booking is only confirmed upon receipt of full payment and written confirmation from WOW.
Eligibility: Retreats are designed for women aged 18 and older. By booking, you confirm that you meet any specific eligibility requirements stated for your chosen Retreat.
Accuracy of Information: You are responsible for providing accurate personal information, including legal name (as it appears on your passport), date of birth, emergency contact details, and any medical conditions or dietary requirements.
What’s Included: Each Retreat description specifies what is included in the price. Unless expressly stated, the Retreat price does NOT include:

Payment in Full: Full payment of the Retreat price is required at the time of booking to secure your place. Your booking is confirmed once payment is received and WOW has sent you written confirmation.
Payment Methods: Payments are accepted via credit card through our secure payment processor, Stripe. You are responsible for any fees charged by third parties or financial institutions in connection with your payment.
Price Guarantee: Once your booking is confirmed with full payment, your Retreat price is guaranteed and will not be subject to surcharges or increases.
Why payment in full: WOW operates small-group Retreats with a maximum of ten participants. We must secure accommodations, guides, permits, and services well in advance, and most of these commitments are non-refundable to us. Your payment allows us to hold your place and commit to those suppliers on your behalf.
You may cancel your booking by notifying WOW in writing via email to wowwomenofthewild@gmail.com. Cancellation is only effective upon receipt and acknowledgment by WOW.

Transfer instead of cancelling: Before you cancel, please consider transferring your place to another eligible person under Section 6. In most cases this allows you to recover more of your payment than cancelling.
No-Shows: Failure to arrive for the Retreat without prior written cancellation will result in forfeiture of all payments with no refund.

We strongly recommend purchasing travel insurance with “cancel for any reason” coverage to protect your investment.
5.1 Cancellation for reasons within our control. WOW may cancel a Retreat for reasons within our control, including insufficient enrolment. In that case you will receive, at your election, a full refund of all payments made to WOW, or a Retreat Credit under Section 5.4 for the full amount paid.
5.2 What is a Force Majeure Event. A “Force Majeure Event” means any event or circumstance beyond our reasonable control, whether or not foreseeable, that makes a Retreat dangerous, illegal, or not viable to operate as described. This includes, but is not limited to: acts of God and natural disasters; earthquake; volcanic eruption or volcanic ash; flood; wildfire; hurricane, cyclone, windstorm, or other extreme or adverse weather; avalanche, landslide, or rockfall; epidemic, pandemic, outbreak of infectious disease, or other public health emergency, and government measures taken in response; quarantine; war, whether actual or threatened; invasion; civil unrest, riot, insurrection, or civil commotion; blockade or embargo; terrorism or threatened terrorism; nuclear, chemical, or biological incident; fire or explosion; cyber incident or failure of communications or IT systems; strike, labour dispute, or industrial action; any act of a government or regulatory authority, including the passage of any law, order, proclamation, regulation, or requirement; a Level 3 or Level 4 travel advisory issued by the US Department of State for the destination; border closure or entry or exit restriction; refusal or revocation of a visa or permit; closure or restriction of an airport, port, airspace, road, national park, or public land; suspension or cancellation of transportation services; and the failure or insolvency of a supplier or accommodation provider.
5.3 What happens if we cancel for a Force Majeure Event. If WOW cancels a Retreat because of a Force Majeure Event, we will divide your payment into two parts:
We will use good faith efforts to recover payments from our suppliers, but we cannot guarantee recovery and we are not obliged to bring legal proceedings against a supplier. Within 30 days of cancelling, we will tell you in writing how your payment has been divided between recoverable and non-recoverable amounts.
Curtailment during a Retreat. If a Force Majeure Event occurs after a Retreat has begun and we must end it early, we will issue a Retreat Credit on a pro-rata basis for the unused portion of the Retreat. You remain responsible for your own onward travel and repatriation costs, which is one reason travel insurance is mandatory under Section 7.
5.4 Retreat Credits. A Retreat Credit works as follows:
5.5 Itinerary Changes. WOW reserves the right to modify Retreat itineraries, accommodations, or activities due to weather, safety, logistics, or circumstances beyond our control. WOW will make reasonable efforts to provide comparable alternatives. A change of itinerary that preserves the substance of the Retreat is not a cancellation and does not give rise to a refund or credit.
5.6 No Additional Compensation. In the event of cancellation or changes by WOW, whether or not caused by a Force Majeure Event, we are not responsible for any incidental expenses you may have incurred, such as non-refundable airfare, visa fees, vaccinations, or gear purchases. Travel insurance is intended to cover these costs.
Transferring Your Booking: If you are unable to attend, you may transfer your booking to another eligible person, subject to:

Your Responsibility: You must provide proof of adequate insurance coverage before the Retreat departure. WOW reserves the right to refuse participation to anyone without valid insurance.
WOW’s Recommendation: We recommend purchasing travel insurance within 14 days of booking to maximize coverage benefits. World Nomads (worldnomads.com) offers policies suitable for adventure travel.
Physical Requirements: WOW Retreats involve physical activities including hiking, trekking, and other adventure activities. You are responsible for ensuring you have the physical fitness and health required for your chosen Retreat.
Medical Disclosure: You must disclose any medical conditions, allergies, physical limitations, or medications that may affect your participation or require special accommodation. This information must be provided on the Medical Intake Form before the Retreat.
Medical Clearance: For Retreats involving strenuous activity or high altitude, WOW may require a physician’s clearance confirming your fitness to participate.
Your Responsibility: You acknowledge that:
Nature of Adventure Travel: You understand that WOW Retreats involve adventure activities that carry inherent risks, including but not limited to:
Voluntary Participation: You acknowledge that your participation is entirely voluntary and that you assume all risks, whether known or unknown, associated with participation in the Retreat.
Personal Responsibility: You are responsible for your own safety and wellbeing during the Retreat. You agree to follow all safety guidelines and instructions provided by WOW staff and local guides.
Release: To the fullest extent permitted by law, you release, waive, and discharge WOW, Rogue Wave Collective LLC, its owners, officers, employees, agents, guides, and affiliated third-party suppliers from any and all claims, liabilities, damages, costs, or expenses arising from:
Waiver: You waive any right to bring legal action against WOW for any claims arising from your participation, except in cases of gross negligence or willful misconduct by WOW.
Indemnification: You agree to indemnify and hold harmless WOW from any claims, damages, or expenses (including attorney’s fees) arising from your participation in the Retreat or breach of these Terms.
Expected Conduct: You agree to:
Removal from Retreat: WOW reserves the right to remove any Participant whose behavior is deemed inappropriate, disruptive, or dangerous. In such cases, no refund will be provided and you will be responsible for your own return travel arrangements and costs.
Independent Contractors: WOW arranges services with accommodation providers, activity providers, transportation operators, guides, and other independent parties (“Third-Party Suppliers”).
Limited Liability: WOW exercises care in selecting Third-Party Suppliers but does not control their operations. WOW is not responsible for acts or omissions of Third-Party Suppliers.
Consent: By participating in a Retreat, you grant WOW permission to photograph and record you during the Retreat and to use such images and recordings for marketing, promotional, and editorial purposes without compensation.
Opt-Out: If you do not wish to be photographed or recorded, you must notify WOW in writing before the Retreat start date.
Data Collection: WOW collects personal information necessary to operate Retreats, including name, contact details, passport information, medical information, and payment details.
Data Use: Your information is used to:
Data Protection: WOW takes reasonable measures to protect your personal information. We do not sell your data to third parties.
Your Rights: You may request access to, correction of, or deletion of your personal information by contacting wowwomenofthewild@gmail.com.
These Terms shall be governed by the laws of the State of Florida, United States of America.
Any disputes arising from these Terms or your participation in a Retreat shall be resolved in the courts of the State of Florida.
If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.
These Terms constitute the entire agreement between you and WOW regarding your Retreat booking and supersede all prior discussions or agreements.
WOW reserves the right to update these Terms at any time. Updated Terms will be posted on our website.
